Florida bill sets rules for data center utilities

The Florida Legislature has introduced a bill creating new rules for data centers, large load customers, utility tariffs, and water permitting.

• The bill would create Section 163.326, affirming that local governments keep authority over comprehensive planning and land development regulations for large load customers, and would define data center and large-scale data center for state law purposes.
• It would require public utilities to file compliant tariffs by October 1, 2026, bar service to certain foreign entities, require some large-scale data centers to use reclaimed water when available, and direct OPPAGA to complete an independent study by July 1, 2027; the act would take effect July 1, 2026 except as otherwise provided.
